Syrian National Arrested in Germany on Charges of War Crimes and Crimes Against Humanity

German authorities announced the arrest of a Syrian national on charges of war crimes and crimes against humanity, connected to a series of alleged offenses committed between 2012 and 2015. The suspect, known as ‘Ahmad H.,’ reportedly partook in extreme cases of torture, killings, and enslavement while operating as a member of a pro-government militia in Syria.

According to a statement released by the German prosecutors, Ahmad H. and the militia he was part of were purportedly responsible for the 2013 Tadamon Massacre, a mass execution incident that claimed at least 41 lives in Damascus’s Tadamon neighborhood. The statement further alleges that Ahmad H. personally took part in the abuse of civilians on various accounts.

One account details a 2013 incident during which Ahmad H. physically assaulted a detainee and instructed the militia members to brutally beat the man for several hours. In 2014, Ahmad, along with other militia members and the Syrian military intelligence service, were reported to have repeatedly assaulted a civilian at a checkpoint before the man was taken away by the militia. Further allegations suggest that between December 2012 and early 2015, Ahmad H. arrested and forced 25 to 30 people to transport sandbags to the nearby front under dangerous conditions, including repeated fire, lack of food and water supply, and physical beatings.

In light of these accusations, the arrest was made under sections 7 and 8 of the Code of Crimes against International Law and section 25 of the Criminal Code. The Code of Crimes against International Law, established by Germany in 2002, permits the prosecution of offenses such as war crimes, crimes against humanity, and genocide, irrespective of where the alleged crime occurred or its relation to Germany.

The German Federal Public Prosecutor’s Office issued an arrest warrant for Ahmad H. after a Federal Court of Justice hearing on July 26. The arrest marks a crucial step in global efforts to bring alleged perpetrators of war crimes and crimes against humanity to justice, even if committed outside their national jurisdiction.
