Colombian Energy Market Adopts New Guidelines for Transparent Price Formation

On July 31, 2023, the Energy and Gas Regulation Commission (CREG) of Colombia issued new guidelines to supervise price formation in the Wholesale Energy Market (MEM), including its associated obligations, as articulated in Article 8 of Decree 0929 of June 7, 2023, of the Ministry of Mines and Energy (MME). Further details were provided by the law firm Holland & Knight LLP.

The implementation of these new guidelines demonstrate CREG’s commitment towards the promotion of transparency and efficiency in energy price formation in Colombia. The creation of a framework for the efficient formation of prices in the MEM will actively contribute towards robust and systematic price information, serving as a foundation for Colombia’s future energy decisions.

In addition to these guidelines, legal professionals working on energy-based cases should note that all players within the energy market will be held to these new standards for price formation. Strict adherence to these parameters could help prevent legal disputes related to pricing activity, along with fostering a healthier competitive energy environment in Colombia.

Going forward, the potential impacts of these new directives on the Colombian energy market will be closely scrutinized by stakeholders and legal authorities alike, thus it would be prudent to stay abreast with the developments in this domain. This highlights the dynamic role of law in shaping and regulating economic processes in the space of energy markets, emphasizing its essentiality as a tool for economic governance.
