GFSC Granted Permission to Appeal, Prolonging Domaille, Clarke & Hannis Legal Saga

The Guernsey Financial Services Commission (GFSC) has recently been granted permission to appeal in the case involving Domaille, Clarke & Hannis, further extending the unfolding legal drama.

This case follows an appeal that was previously made against sanctions imposed on Domaille, Clarke & Hannis by a Senior Decision Maker (SDM) chosen by the GFSC. The appeal was successful, as LB Marshall KC acknowledged in the Royal Court Judgment.

Our earlier piece covered the details of the Royal Court Judgment’s findings. A significant development since the publication of that article is the approval of GFSC’s request to appeal.

It’s not yet clear how this move will affect the larger context of financial regulatory enforcement, particularly in an international perspective. Regardless, this situation underscores the inherent complexity and interwoven relationships between financial institutions, regulatory bodies, and the legal measures available to them.
