EEOC Unveils Proposed Regulations for Pregnant Workers Fairness Act Enforcement

The Equal Employment Opportunity Commission (EEOC), on August 7, 2023, unveiled its proposed regulations for the enforcement of the Pregnant Workers Fairness Act (PWFA). This move comes in response to the PWFA, which was enacted in 2022 and imposes requirements on employers to furnish reasonable accommodations for workers who are impacted by pregnancy, childbirth, or any associated medical condition. The full details on this proposal were released by Vedder Price.

The PWFA, in scope and intent, aims to safeguard the rights of pregnant workers, ensuring that they are not sidelined in the workplace due to pregnancy, childbirth, or related medical conditions. This targets the elimination of workplace discrimination which pregnant workers might face, thereby granting them the necessary amenities and conditions conducive for work during such times.

With the proposed regulations, the EEOC aspires to strengthen the implementation of PWFA and assure employers’ compliance with the provisions of the act. While several employers might already have instituted policies in-line with the PWFA, these regulations will provide a clear legal framework that reinforces the necessity of these accommodations and further safeguards the rights of pregnant workers.

While the full effect of these regulations will be observed in the long run, it is expected that these reforms will contribute to establishing a fairer and more inclusive work environment for pregnant workers. In the meantime, employers should stay updated with these proposed rules and accordingly prepare to make any necessary adjustments to their policies and practices.
