Court Upholds Vineyard Wind’s Construction Despite Right Whale Concerns

In a recent court ruling, the United States District Court for the District of Massachusetts granted summary judgment in favor of the National Marine Fisheries Service (NMFS) on Friday, August 4, 2023. The judgement comes in the case of Melone v. Coit et al, 21-cv-11171 (Talwani, J.). More information about the judgement can be found here.

The court found that NMFS adhered to the standards set by the Marine Mammal Protection Act (MMPA) when they authorized the construction of the Vineyard Wind project. This conclusion was reached disregarding the project’s potential impacts on the North Atlantic right whale, scientifically known as Eubalaena glacialis.

This species of whale holds protections under both the MMPA and an undisclosed authority. Despite challenges to the Vineyard Wind project concerning these marine mammals’ protections, the civil court rejected such arguments and proceeded with the project’s authorization.

The specifics of the judgement, the challenge, and potential consequences of this decision could lead to further discussions and potential implications for future wind projects and the protections held for marine wildlife. Legal professionals in the field must pay attention to such decisions, as the landscape of environmental protection laws continues to evolve and adapt to new energy projects and their potential impacts on our aquatic life.
