The U.S. Court of Appeals for the Ninth Circuit recently ruled that Hawaii’s ban on “butterfly knives” is a violation of the Second Amendment. They found that the knife, resembling a folding pocketknife, qualifies as an “arm” under the amendment’s terminology.
A district court’s previous summary judgment in favor of Hawaiian officials was overturned by the Ninth Circuit. The decision established that the ban infringed upon the Second Amendment’s rights, as bladed weapons are classed as “arms”. The court noted that even at the adoption of the amendment, the term “arms” included such weapons.
