A Connecticut district judge recently dismissed Kohl’s motion for summary judgment in a slip-and-fall case, allowing for further legal proceedings. The judge determined that significant questions remain regarding whether a faulty condition was present, whether Kohl’s was aware of this alleged state, and if the retail giant failed to respond appropriately.
According to an August 16th court document, Judge Stefan R. Underhill of the District of Connecticut rendered the decision against Kohl’s in the case against Myrta Taylor. The next step for the parties involved is to inform the court within 14 days whether they want to refer the case to a magistrate for settlement talks or move forward to trial.
Taylor’s attorney, Edwin Camacho of Ventura Law, Norwalk, voiced his approval of the judge’s verdict, asserting there are enough facts to warrant presenting the case to a jury, which renders a motion for summary judgment unsuitable.
