Rare Secondary Insurer Settlement Offer Leads to Defense Victory in Savannah Court

Defense attorneys Matt Moffett and Sean Herald of Gray Rust St. Amand Moffett & Brieske recently secured a victory against a plaintiff’s team represented by Morgan & Morgan’s Seth Diamond, Kendall Shortway, and William Degenhart in the State Court of Chatham County in Savannah, Georgia. Moffett and Herald were hired by the insurer to defend this case, which was initially managed by Herald in its pre-trial stages.

Notably, this case involved a relatively rare circumstance where a secondary insurer participated in settlement negotiations once the primary insurer had reached its settlement cap. Moffett shed some light on this unusual scenario by stating, “In situations like this, you don’t often see the excess carrier, who obviously appreciated a risk, negotiation with the plaintiff’s attorney.” He further explained that most excess carriers do not offer a settlement until the underlying insurance carrier has exhausted their funds.
