The Washington County Landfill Expansion’s saga continues to unfold as Individual Petitioners and the Mayor of Tontitown, Russell, jointly filed a brief in support of a second motion for summary judgment. As previously noted in our discussions on April 19th and 18th, Mayor Russell and certain individuals independently submitted separate Requests for Adjudicatory Hearing and Commission Review (collectively “Petitioners”) before the Arkansas Pollution Control & Ecology (“Commission”). The Petitioners put forward these legal actions as a response to the Arkansas Department of Energy & Environment – Division of Environmental Quality’s (“DEQ”) decision to grant a permit for the Eco-Vista Landfill.
