Illinois Sets Precedent with Comparable Pay Mandate for Temporary Workers

In a significant modification to the labor laws, Illinois has mandated comparable pay for temporary workers, setting a precedent for future labor-related regulations. Governed by the newly signed HB 2862, future wage arrangements in the state will see a substantial change.

On August 4, 2023, the Governor of Illinois assented to this pivotal change by signing HB 2862, thereby amending the Illinois Day and Temporary Labor Services Act (DTLS).

Designed with the intent of reducing a vast wage disparity, this reform was a critical step towards ensuring that temporary workers receive pay at par with their non-temporary, or permanent, colleagues doing the same job. This signifies a notable progression in labor laws that traditionally tend to overlook the rights of temporary and day laborers.

The bill is a result of the joint efforts of numerous advocates for labor rights who sought to rectify wage inequities within the workplace.

The amendment is expected to have widespread implications on existing businesses. Corporate legal professionals, particularly those within Illinois, should follow this development closely as it transforms the legal landscape concerning wage equities and temporary labor rights.
