NLRB Amends Federal Regulations Governing Representation Election Procedures: Implications for Employers and Employees

On August 24, 2023, the National Labor Relations Board (the “Board”) issued a final rule amending the federal regulations that govern representation election procedures, according to an update by Littler.

The 2023 final rule is the latest action in a series of changes that the Board has made over the years, alternately shortening or lengthening the period from the filing of a petition for union representation to the holding of an election, and from the election to the certification of the election results, a process known as the “representation election process”.
