Massachusetts Prosecutor Disbarred, Thousands of Drug Convictions in Doubt

A former Massachusetts prosecutor, Anne Kaczmarek, has been disbarred due to her failure to disclose exculpatory evidence in a drug theft case. This serious lapse has cast widespread doubts over the integrity of the criminal justice system.

Kaczmarek’s derelict behavior could potentially have an impact on thousands of defendants who were previously convicted on drug charges. This is a landmark case as Kaczmarek becomes the first ex-member of the Massachusetts attorney general’s office to be disbarred.

Two other former assistant attorneys general were also disciplined in this major episode. John Verner, a former state prosecutor who had overseen Kaczmarek, received a public reprimand. The other, Kris Foster, an ex-junior prosecutor, was handed a suspension for one year and one day. The disciplinary actions have triggered the dismissal of over 24,000 convictions across 16,500 cases.
