Colombia’s MADS Adopts New Environmental Regulations, Impacting Industries and Compliance Practices

The Ministry of Environment and Sustainable Development (MADS) of Colombia has issued Resolution 839 on the 28th of August, 2023, replacing Resolution 941 of 2009. This new piece of legislation brings about amendments pertaining to the Information Subsystem on the Use of Renewable Natural Resources (SIUR) and the Unique Environmental Register (RUA).

This action entails the adoption of a monitoring and tracking protocol for SIUR. Furthermore, it also incorporates modifications for the productive sectors and the Registry of Emissions and Transfer of Contaminants (RETC).

The provisions introduced by the resolution facilitate a more integrated approach for dealing with renewable natural resources, emissions, and contaminants, while also potentially reshaping practices within the mentioned sectors.

With the implementation of this new decree, we anticipate a shift in legalities and operational procedures for businesses in the relevant industries. The transformation is expected to promote stronger compliance with environmental norms and standards, fostering a more sustainable approach to industrial practices.

Organizations subjected to this reform should account for these changes in their legal strategies, specifically those concerning environmental impact and sustainability. Navigating the intricate landscape of environmental law might necessitate legal counsel, as non-compliance can result in hefty penalties or legal liabilities.
