Panel Seeks Dismissal of Judge Pauline Newman’s Lawsuit Amid Competency Investigation

A special committee has requested the U.S. District Court to dismiss a lawsuit from 96-year-old Judge Pauline Newman that aims to halt an investigation into her competency. The committee, leading the inquiry, submitted their request during a hearing on Friday.

The panel from U.S. Court of Appeals for the Federal Circuit argued in their 67-page motion that the Judicial Conduct and Disability Act—a federal law that determines judicial misconduct—restricts judicial review of panel decisions. These include the panel’s decision to resist moving the investigation to another circuit.
