In a recent ruling, an Ohio appeals court reversed and remanded a jury verdict of nearly $1 million relating to a medical malpractice case, citing prejudicial errors and improper jury instruction at the trial court level. These errors, according to the appellate court, compromised the defence’s case warranting a new trial.
The September 1 opinion authored by Judge Pierre H. Bergeron for the First District Court of Appeals of Ohio, highlighted several critical errors made against the defendants. The defendants in this case include Dr. Abubakar Durrani and the Center for Advanced Spine Technologies Inc. (CAST). According to the appellate decision, errors were predominantly committed by plaintiff’s counsel during trial.
Consequently, the defendants are now entitled to a new trial where the jury will consider the case anew, divorced from the prejudicial evidence that intruded the first trial. As such, it would be of interest to legal professionals to follow this case closely as it unfolds, providing insights into matters related to court procedure and the handling of evidential issues during trials.
