Supreme Court to Tackle First and Second Amendment Cases in November Session

The U.S. Supreme Court has unveiled its list of seven cases to be argued in the November session, according to a report by SCOTUSblog. Two of the high-profile matters in this to-be-argued list are central to the exercise of the First and Second Amendment rights.

A Second Amendment dispute, namely United States v. Rahimi, is set to be scrutinized. This case presents a challenge to the constitutionality of a federal ban on the possession of guns by individuals subjected to domestic violence restraining orders. The case involves Zackey Rahimi, a Texas man issued with a restraining order after a 2019 domestic incident. He was subsequently charged for violating the federal ban after police discovered guns and ammunition at his residence.

The court will also hear O’Connor-Ratcliff v. Garnier and Lindke v. Freed, cases centered on challenges to the constitutional correctness of public officials blocking constituents on social media. These cases arose from officials blocking constituents who posted critical comments. Federal appeals court rulings have varied, with one viewing such blocking as governmental action that contravenes the First Amendment.

The November session’s other cases – Vidal v. Elster, Department of Agriculture v. Kirtz, Rudisill v. McDonough, and Culley v. Marshall – will deal with matters including civil asset forfeiture laws, sovereign immunity, and veterans’ rights. The session is due to begin on October 30.
