MarkIt to Market®’s latest edition reveals a forthcoming addition to the U.S. Patent and Trademark Office (USPTO) practice. In early August 2023, the USPTO disclosed its plan to issue a “Welcome Letter” to applicants or their legal representatives who have lodged new trademark applications.
The reveal for the welcome letters came from Sterne, Kessler, Goldstein & Fox P.L.L.C., who clarified that the USPTO will be sending the letters either electronically or by postal service. These welcome materials will be tagged with the filing receipts made for recently filed applications.
Beyond just a generic welcome, these letters will offer more than a standard greeting. They aim to provide guidance and useful resources for brand owners, aiding them in gaining a nuanced understanding of the application process and the workings of the USPTO.
While this is a positive move by the USPTO, law professionals must remain tuned in to how the Office will handle this new process, how the timing of these “Welcome Letters” will influence the process, and whether or not it will benefit applicants in the long run.
