Nestle Faces Revived Class Action Lawsuit Over “Premier White Morsels”

On August 15, 2023, Nestle faced a reversal in its previous legal fortunes as a class action lawsuit concerning its “Premier White Morsels” Toll House product was revived by a panel of judges from the United States Court of Appeals for the Ninth Circuit. The lawsuit, titled Prescott v. Nestle USA, No. 22-15706, had faced a ruling at the district court level that didn’t favor the plaintiffs, a decision which has now been vacated by the appeals court. The court has remanded the case back to the district court, urging it to reassess its verdict considering the California Court of Appeal’s verdict in the case of Salazar v. Walmart, Inc., 83 Cal. App 5th 561 (2022).
