Barney Gush, an associate of the Real Estate Disputes practice in the London office of legal services firm Eversheds Sutherland, is currently facing charges for inflicting grievous bodily harm. The charges come in the aftermath of an alleged incident that took place during a night out in September 2021 wherein Gush is accused of fracturing the jaw of investment banker, Jonathan Luke. However, Gush maintains his actions were a direct response to being subjected to a homophobic slur at a London bar. This incident was initially reported by RollOnFriday.
Jonathan Luke, recounting the incident, allegedly admitted to being “reasonably tipsy” during the incident. He described the punch as a surprising and sudden impact, which resulted in a displaced jaw. The injury was serious enough to necessitate the insertion of two metal plates to reposition the jaw.
The defendant’s attorney, Aisling Byrnes, asserts a contrary narrative of the events, claiming that Luke was “very drunk” and was causing disturbances on the dance floor. Allegedly, Gush was subjected to a homophobic slur due to his flamboyant dance style, which Luke denies.
According to Gush’s account of the event, Luke had made physical contact with him while dancing. Following this, Gush had requested Luke to stop bumping into him, a claim Luke refutes. Prosecutors have questioned Gush’s account, stating that there was no act of violence on Luke’s part necessitating self-defense.
The trial is ongoing and its outcome will undoubtedly set a precedent for similar future cases.
