Effective June 2, 2023, a significant regulation update comes into effect which will alter federal contracts and solicitation requirements. All such contracts are required to include the Federal Acquisition Regulation (FAR) clause: FAR 52.204-27, titled “Prohibition on a ByteDance Covered Application”. This clause is a concrete implementation of Section 102 of Division R of the Consolidated Appropriations Act of 2023, otherwise known as the “No TikTok on Government Devices Act”.
As the title of the regulation suggests, the central focus is on applications owned by ByteDance, the Chinese company most well known for its social media platform, TikTok. This new regulation signals a growing concern over data security in relation to foreign-owned digital platforms. Critics of ByteDance have suggested the company’s data practices allow user information to be readily accessed and potentially misused by the Chinese government.
While the incoming regulation addresses a valid concern, it does not cast a wide enough net to be fully effective, leaving some areas shrouded in ambiguity. Notably, the new rule does not extend to all contractors’ IT or employees’ personal devices, naturally raising questions over the robustness of its implementation and efficacy in achieving its stated objective.
The potential gaps left by the exclusion of some contractor IT and personal devices may leave federal data vulnerable to the very risks the regulation attempts to counter. The ability for TikTok to remain on personal devices used by government contractors poses an unresolved issue in regard to the protection of sensitive federal information.
