Murdaugh Defense Seeks New Trial, Claiming Unrelated Evidence Prejudiced Jury

Alex Murdaugh, a South Carolinian attorney who became a household name after taking a gunshot to the head while changing a tire, has sought a new trial. It was not just his near-death experience that made headlines. Peculiar circumstances surrounding the incident, including whether the tire had been deliberated damaged and its possible connections with the earlier murder of his wife and son, made Murdaugh’s story even more convoluted. Consequently, a series of charges such as embezzlement, money laundering, and a convoluted insurance scam followed, causing comprehensive media coverage. Read more

During the trial, Murdaugh’s legal team took an unusual approach when his defense attorney pointed a gun at the prosecutor. Despite these unorthodox methods, Murdaugh was convicted of the family murders. Now, the same defense attorney is seeking a new trial on the basis that the jury was exposed to an excessive amount of evidence unrelated to the actual murder charges. Attorney Dick Harpootlian made his argument at CrimeCon 2023, stating that three weeks of financial crime exposition seriously prejudiced the jury against Murdaugh to the point where they couldn’t consider any evidence favoring his innocence. Many perceive this argument as a weak appeal for a retrial. For one, the evidence related to Murdaugh’s financial misdemeanors could be considered relevant as it established motive for the murders. Moreover, blaming the prosecution for the accumulated evidence of financial wrongdoings may not hold water, as the overarching case is about Murdaugh executing his family due to his financial predicaments. A new trial over this seems unlikely.

There is also an air of skepticism over Harpootlian presenting his appeal at CrimeCon 2023 – a true crime festival. Such a setting – a blend of tabloid enthusiasts and conspiracy theorists – may not add much credibility to their cause.
