In response to the shifting legal landscape related to international transfers of personal data and its compliance with the General Data Protection Regulation (GDPR), the European Data Protection Board (EDPB) has released an updated version of its Recommendations 01/2022 on Binding Corporate Rules for Controllers (C-BCR).
Interestingly, amidst the upheaval from the “Schrems II” ruling by the European Court of Justice (CJEU), the Binding Corporate Rules solidified their standing as an exceptionally strong mechanism for these transfers, proving themselves to be a sort of ‘gold standard’.
The revisited EDPB guidelines further establish and fortify this mechanism, which is anticipated to stimulate discussion and new developments in GDPR compliance and data transfer realms. Given the rapid changes and possible future actions, reviewing, and understanding these guidelines is critical for legal professionals tasked with the responsibility of maintaining their corporations’ GDPR compliance and data protection adherence.
