FMCSA Seeks Public Input on Advanced Motor Carrier Safety Fitness Determinations

The Federal Motor Carrier Safety Administration (FMCSA) continues to make strides in establishing advanced motor carrier safety fitness determinations (SFDs). On August 29, 2023, the FMCSA published an advanced notice of proposed rulemaking (APRNM) as well as a request for public comment. This effort is part of their responsibility to fulfill the directive of the Motor Carrier Safety Act of 1984, which mandates both the creation and periodic update of motor carrier SFDs.

Importantly, the APRNM offers stakeholders a window of influence over the potential new era of federal SFDs. They can provide critical feedback to the FMCSA up until October 30, 2023. This interactive process ensures that a wide range of perspectives and experiences can shape the proposed rules for motor carrier safety.

It is noteworthy that such a move sends strong signals about the FMCSA’s commitment to enhancing motor carrier safety regulations. By opening up the rule-making process for comment, the agency provides relevant parties with the opportunity to contribute in a meaningful way to the safety assessments shaping the industry.

Legal and transportation professionals are encouraged to engage with these rulemaking processes to ensure their perspectives and knowledge are incorporated. The involvement of such key individuals can bring about rules that, while safety-centric, are also practical and implementable in the real world of transportation operations.
