Ohio Court Upholds Defense Verdict in Medical Malpractice Suit Amid Informed Consent Controversy

The Court of Appeals for the First Appellate District of Ohio recently upheld a jury’s verdict, ruling in favour of a doctor and a plastic surgery center implicated in a medical malpractice suit. The suit originated from the family of a patient who passed away due to medical complications following treatment.

The patient’s family alleged medical malpractice along with a failure to secure informed consent. In a
September 6 opinion penned by Judge Jennifer Kinsley, lack of informed consent was a key component in the jury’s instruction. The presiding court determined that no plain error occured when the conclusion section of the instructions was provided to the jury or when an interrogatory was issued by the trial court.
