The Securities and Exchange Commission (SEC) has proposed adjustments to the EDGAR Filer access and account management policies, as indicated by a recent publication from Seward & Kissel LLP, accessible here.
The proposed amendments would require entities that make filings with the SEC using the EDGAR system, including investment advisers making Form 13F and Form 13H filings, to authorize and maintain individual account administrators to manage the filer’s EDGAR account.
This development would be notably of interest to registered investment companies and investment advisers. This proposal aims at tightening up administrative protocols thus improving the overall security of information transmitted by filers within the EDGAR system.
As per the proposed amendments, these individual account administrators would be responsible for authorizing, deactivating, and maintaining the account of each filer. They will essentially have the ability to have direct control over who has access to sensitive document filing systems, allowing for more internal regulation and potentially drastically reducing the risk of unauthorized access.
While final details and implementation protocols remain to be seen, this key proposition underscores a trend towards sturdier operational security considerations in the domain of legal and financially sensitive data management.
