Class Certification Granted in Hill’s Pet Nutrition Prescription Diet Lawsuit

It has taken seven years, but a claim lodged by pet owners against company Hill’s Pet Nutrition, regarding their prescription requirement for its Prescription Diet food, has been partly granted class certification by a district court judge in Illinois. The case under scrutiny is Holly Blaine Vanzant v. Hill’s Pet Nutrition, filed in the U.S. District Court for the Northern District of Illinois, Eastern Division.

In their second amended complaint, the plaintiffs accuse Hill’s Pet Nutrition of deceptive practices. They allege that the company’s requirement of a prescription to sell its Prescription Diet food allowed Hill’s and also PetSmart, to sell this product at prices above the market average, under the guise of it being a prescription item. This is despite the fact that the pet food does not contain any ingredients that could be classified as a drug, medicine, or disease preventative, as stated in the court’s opinion.
