EEOC Proposes Clarified Guidelines: Enforcement Guidance on Harassment in the Workplace

The Equal Employment Opportunity Commission (EEOC) has recently presented a proposal for new “Enforcement Guidance on Harassment in the Workplace.” This forthcoming guidance is particularly notable for its provision of detailed elucidations of the standards for harassment and employer liability under a variety of enforced laws. These laws include the Age Discrimination in Employment Act of 1967 (ADEA), Titles I and V of the Americans with Disabilities Act of 1990 (ADA), the Equal Pay Act of 1963 (EPA), Sections 501 and 505 of the Rehabilitation Act of 1973, and Title VII.

The proposal is pivotal considering the immense effects these laws have on corporate landscapes. With clearer guidelines for a range of discriminatory behaviors, corporations will have a more nuanced understanding of what constitutes harassment under each of these determinative acts. This will help them tailor their policies appropriately, thus reducing the risk of violating any of these laws.

The EEOC’s new proposition is open for public comment until November 1, offering professionals in the legal and corporate sphere an opportunity to contribute their perspectives and potentially influence this influential piece of guidance.
