In an era frequently characterized by rapid technological evolution, Scott Milner, the newly appointed global head and practice group leader of Morgan, Lewis & Bockius’ e-data practice group, believes there is a pressing need to review and perhaps reformulate some existing e-discovery principles. This is especially true for long-standing protocols around the management of Electronically Stored Information (ESI).
Having been part of the firm’s e-data practice since its early days, Milner vividly recalls the age when e-discovery largely translated to suffering numerous “paper cuts in warehouses.” However, with the unceasing advance of technologies such as AI and emergence of new realms of data, the landscape of the profession has changed dramatically.
As we approach 2024, Milner anticipates facing a unique set of challenges and opportunities, many born out of the confluence of traditional ESI protocols and newer, digitized discovery technologies.
