Ohio Contemplates Legalization of Recreational Marijuana: Issue 2’s Economic Impact and Regulatory Prospects

Between October 11 and November 7, 2023, Ohio will become the latest state in the US to contemplate the legalization of recreational marijuana use for adults. Voters will decide whether to approve Issue 2 – a voter-initiated law named “To Commercialize, Regulate, Legalize and Tax the Adult Use of Cannabis”.

A simple majority vote is enough to pass this legislation. If passed, Ohio citizens over the age of 21 will be legally allowed to grow up to six plants and possess up to 2.5 ounces of cannabis for personal use. Operational licensing for marijuana-related businesses would be established through the newly-created Commerce Department Division of Cannabis Control.

Furthermore, the law proposes the establishment of a 10% adult use tax on cannabis purchases, which would be in addition to any regular sales tax. This move could potentially generate substantial revenue for the state, posing substantial implications for the local economy.

The approval of Issue 2 will set the stage for a new era of legalized adult-use cannabis in Ohio, joining 18 other states and the District of Columbia where recreational marijuana use is already legal. The impact of this potential change would be considerable, affecting not only consumers but also businesses and professionals operating in the state’s expanding cannabis industry.
