On the 29th of August, 2023, the Internal Revenue Service (IRS) issued a Proposed Regulation Notice and a Public Hearing Notice for proposed regulations on digital assets. The Proposed IRS Digital Assets Regulations address issues of information reporting, the determination of amount realized and basis, and backup withholding for certain sales and exchanges of digital assets by enforcing requirements for brokers, digital asset trading platforms, and others.
The obligations of reporters, including brokers who deal with digital assets, are fundamentally explored in the proposed regulations. The IRS insists on accurate and comprehensive reports with the objective of enhancing the precision of taxpayers’ returns and minimizing the requirement for amendments.
The rules also entail details on the determination of the amount realized in a sale or exchange of digital assets. These regulations serve to provide specifics on the calculation of transfer charges by platforms or intermediaries. Addressing the backup withholding provision, the IRS provides guidelines on the procedures to be followed to ensure compliance with the set rules.
With digital currencies becoming more prevalent in business transactions, these regulations will set the ground rules for how these transactions should be reported and regulated to ensure fair and legal dealing. The IRS has committed to a public hearing to facilitate stakeholders’ feedback.
