EU Adopts Consumer Credit Directive II: Balancing Digitalization and Responsible Lending

The Council of the European Union has adopted the final text of the Directive on consumer credits, otherwise known as the Consumer Credit Directive II (CCD II). This directive is set to revise and replace the existing Consumer Credit Directive (2008/48/EC).

Upon adoption, the next procedural step towards realization is the imminent publication in the Official Journal of the EU. CCD II will officially come into force on the twentieth day after its publication in the journal.

The CCD II is an important legislation in the digital era, aiming to balance the benefits of digitalization in terms of accessible credit against the potential risks of irresponsible lending practices. These risks can be particularly significant in online customer journeys, where high-speed processes may encourage hasty decisions regarding credit.

Navigating this balance, the CCD II seeks to harness the prevalent use of digital platforms in financial transactions while safeguarding the consumer from potential pitfalls in the online landscape. By revising the existing directive, the EU is sending a clear signal of its commitment to consumer protection in the rapidly evolving digital finance sector.
