Law Firm Rescinds Job Offers Over Controversial Statements on Israel-Hamas Attack

Davis Polk & Wardwell, the prominent law firm, has rescinded job offers previously extended to three law students who held leadership positions in student organizations that endorsed controversial statements following the destructive Hamas terrorist attack in Israel. These students, enrolled at Columbia and Harvard, were mentioned in an internal email sent by Davis Polk’s chair, Neil Barr, though their identities were kept confidential.

Barr’s email pointed out that the declarations made by the student groups were fundamentally at odds with the firm’s ethos, leading to the necessary action of retracting their employment offers. The intention is to uphold a safe and welcoming work environment for all Davis Polk employees, as stipulated by Barr. The New York Times reports that two of the affected students are still engaged in dialogue with the firm.

Davis Polk may be reconsidering their decision for two of the students who opposed their dismissals and claimed they did not authorize the letters, which lacked any personal signatories. This potential reversal underscores the complexities of handling such emotionally charged and divisive issues for both employers and employees.

Following similar lines, Winston & Strawn had previously revoked a job offer extended to the president of NYU Law’s Student Bar Association, due to a school-wide newsletter that characterized the Hamas attack on Israel as “necessary”. Recent actions from these Biglaw firms could be setting a precedent, indicating the type of conduct they find acceptable. It is obvious that certain controversial opinions expressed by potential new hires have crossed an unacceptable line. As the legal profession continues to watch, it remains to be seen which firm will be the next to withdraw job offers.
