EEO-1 Reporting Period Approaches: Ensuring Compliance and Evaluating Workforce Demographics

It’s time to revisit the fundamentals. The reporting period for private sector employers and federal contractors, who are obliged to provide yearly demographic data to the U.S. Equal Employment Opportunity Commission (“EEOC”), opens on October 31, 2023. These disclosures, known as EEO-1 Component 1 reports or “EEO-1 reports”, must be handed in by the end of the reporting period on December 5, 2023.

These mandatory submissions are significant because they assist in enforcing federal laws making it illegal to discriminate against a job applicant or an employee because of the person’s race, color, religion, sex, national origin, age (40 or older), disability or genetic information. Also, most employers with at least 10 employees must file the EEO-1 report.

Now is the right time for every business to evaluate its EEO-1 reporting status and realize how to effectively comply with any requirements. Thus, in accordance with legal firms such as Ballard Spahr LLP, it’s necessary to take preemptive steps and safeguards to ensure that your corporation is within compliance and adequately prepared for EEO-1 reporting.

For those who are not entirely familiar, the EEO-1 report is a compliance survey mandated by federal laws and regulations. The survey requires company employment data to be categorized by race/ethnicity, gender and job category. It’s a tool that aids the EEOC’s office in supporting civil rights enforcement and identifying current trends regarding the employment status of minorities and women.

As we’re approaching the EEO-1 reporting period, careful monitoring and assessing of workforce demographics data is crucial. Training and engagement at all levels of the company – most notably among human resources and management professionals – should be in place to guarantee that correct data is gathered.

Consider the forthcoming period as an opportunity to establish or update standard operating procedure for aggregate data collection, as well as to design a strategy to handle any prospective non-compliance issues. Having your business compliant with EEO-1 reports can save from severe penalties imposed by the EEOC.
