US Union Files Antidumping Petition on Thai Truck and Bus Tire Imports

On October 17, 2023, the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union, AFL-CIO, CLC (the Union) lodged an antidumping duty (AD) petition on truck and bus tires originating from Thailand. This information is made available by Faegre Drinker Biddle & Reath LLP.

The petition by the Union is in response to allegations that Thai manufacturers are selling truck and bus tires at less than fair value in the U.S., thereby causing or threatening to cause material injury to the domestic industry. Antidumping duties, if imposed, could cause significant impacts on importers, increasing costs and potentially disrupting supply chains.

Anti-dumping laws serve to protect domestic industries against overseas companies ‘dumping’ products on the market at prices lower than the cost of production, or their home market prices. If the International Trade Commission (ITC) and the Department of Commerce find sufficient evidence to justify the claim, antidumping duties could be imposed.

It’s important to remember this move by the Union could potentially ripple through the legal landscape, especially for companies with business interests in tire manufacturing, sale and distribution. Therefore, corporations and legal firms should stay abreast of developments in this case and consider likely implications for their clients or their practice.

In the coming weeks, the ITC and the Department of Commerce will be initiating investigations based on the petition. Given the substantial impact it could have on businesses and supply chains, it will be crucial to keep a close eye on the proceedings.
