Burger King, the renowned fast-food chain famed for its flame-broiled Whopper and integral role in launching the Marvel cinematic universe, is pushing back against accusations made against its advertising strategies. According to Reuters, a proposed class-action lawsuit alleges the company deceived customers about the size of its burgers and sandwiches. The fast-food giant has petitioned for sanctions against the lawyers responsible for the lawsuit.
The amended suit, submitted last month, received a scathing response from Burger King. In its request for sanctions, the company opined that the complaint is baseless and unprecedented, questioning the legality of an establishement showcasing appealing photos of menu items.
While the pushback against the lawsuit continues, it’s worth noting that this is not the first instance where a fast-food company has faced similar allegations. Wendy’s was implicated in a connected lawsuit, which made similar claims about food not matching the advertisements. This lawsuit, however, was dismissed in September. The case against Burger King has been filed in the U.S. District Court for the Southern District of Florida under the name ‘Walter Coleman, et al., v. Burger King Corporation’, and its case number is 1:22-cv-20295.
As the saga continues, legal professionals worldwide will be watching the unfolding events with keen interest, expecting crucial implications for advertising strategies in the fast-food industry.
