Addressing Wrongful Convictions: A Conversation with Brian Banks and Michael Semanchik

In an intriguing turn of events, LawNext strayed somewhat from its standard discussion topics towards the dark but vital legal issue of wrongful convictions. In this episode, the spotlight was placed on Brian Banks, whose dreams of an NFL career were derailed when he was falsely accused of sexual assault at the tender age of 16. This incident, which led to a plea bargain that imprisoned him for five years, has since turned Banks into a fervent advocate for criminal justice reform.

The discussion was hosted at the recent Clio Cloud Conference. Participating alongside Banks was Michael Semanchik. Semanchik, the lawyer who successfully rehabilitated Banks’ reputation, previously served as managing attorney of the California Innocence Project. More recently, Semanchik has established The Innocence Center, of which he is the executive director. Semanchik is also the host of what is quickly becoming one of 2023’s finest new podcasts, the soon-to-be-renamed California Innocence Center Podcast.

For Banks, the tale had a happy closing: he managed to vindicate himself and even secure a brief stint in the NFL. Nonetheless, the issue of wrongful convictions remains a major concern for the criminal justice system. In this episode, Banks lays bare his personal history and the discussion expands to investigate what measures could be taken to prevent other innocent individuals from suffering similar injustices.
