On October 19, 2023, the Consumer Financial Protection Board (CFPB) announced a newly proposed rule that intends to provide consumers with improved access to and control over their financial data.
Detailed in a release by Ballard Spahr LLP, the proposed Personal Financial Data Rights Rule (Proposed Rule) would grant bank customers nationwide privacy rights comparable to those under the dozen state privacy laws that have been recently enacted.
As proposed, this rule would not only allow consumers greater control over their financial data but also position them to make more informed financial decisions. They would have the ability to access their data held by their financial institutions, potentially resulting in a more transparent relationship between the financial institution and the consumer.
With the growing importance of data privacy and the increasing digitization of financial services, it’s crucial to ensure that consumers’ financial information is not just secure but also accessible to them. This proposed rule from the CFPB could mark a significant step towards achieving this goal.
Please note that the Proposed Rule is still at the comment stage. Following the CFPB’s ordinary procedures, comments on the Proposed Rule are due on or before a yet to be announced date in December. Legal professionals, particularly those dealing with financial institutions, are thus encouraged to keep a close watch on developments.
