Proskauer Rose and Former COO Approach Settlement in Trade Secrets Battle

The legal dispute between the prominent law firm, Proskauer Rose, and its former Chief Operating Officer (COO), Jonathan O’Brien, seems to be drawing to a close. After a year of litigation, it now seems a settlement may be reached in the coming month, as indicated in a recent court filing.

The case was initiated in the Southern District of New York in late 2022 after Proskauer Rose, claimed that O’Brien had misappropriated firm information. The law firm alleged that more than 34 gigabytes of sensitive internal documents had been stolen by O’Brien shortly before he announced his intention to leave for competitor law firm, Paul Hastings.

In a twist to the saga, Paul Hastings disclosed in January that the job offer to O’Brien was no longer active. This was subsequent to the lawsuit being filed.

Underscoring these happenings, in a letter dated Tuesday, O’Brien’s lawyer conveyed to Judge Analisa Torres that both parties were looking forward to finalizing a settlement agreement within approximately 30 days. This proposed settlement could be a turning point, offering a conclusive resolution to the legal dispute that has been ongoing for over 10 months.
