On October 31, 2023, the National Labor Relations Board (NLRB) and the Occupational Safety and Health Administration (OSHA) built upon their ongoing commitment to ensuring safe and healthy workplaces. They announced the execution of a
Memorandum of Understanding (MOU) aimed at strengthening their joint efforts of promoting workplaces where workers’ voices can be sufficiently heard.
The MOU entails a closer collaboration between these two agencies, enabling them to share critical information to facilitate more comprehensive workplace inspections. This increased level of cooperation will ultimately result in a more powerful enforcement of the existing health and safety regulations to guarantee the rights of workers.
Besides information sharing, the agreement also includes cross-training between the NLRB and OSHA officials. It is envisioned that this mutual sharing of knowledge and experiences will lead to more effective investigative efforts regarding workplace safety complaints.
The MOU does not only stop at information sharing and cross-training, but it brings into focus collaborative investigations on potential offences against workers’ rights. This partnership points to an era where transgressions against workers’ rights will be thoroughly scrutinized, with possible perpetrators potentially facing coordinated enforcement from both agencies.
In effect, the MOU forms just another part of the broader efforts by the NLRB and OSHA to enhance safe and healthy workplaces. It is an acknowledgment that the mission to safeguard workers is too vital to be left to just one agency. Cooperation between agencies will help ensure that gaps are more effectively detected and filled, and the vision of a safer and healthier workplace environment is realized.
