On October 19, 2023, the U.S. Environmental Protection Agency (EPA) published a final rule imposing limitations on the use of certain hydrofluorocarbons (HFCs). The substances under restriction are primarily used in aerosols, foams, refrigeration, air conditioning, and heat pump products and equipment.
Conducted under the American Innovation and Manufacturing Act of 2020, the rule signifies the first implementation of the technology transition requirements under subsection (i). The rule is intended to greatly reduce the environmental impact of these widely-used products by transitioning away from HFCs, which have been shown to contribute significantly to climate change.
As professionals in the corporate and legal world, this change prompts a more cautious approach towards the use and manufacture of products containing HFCs. Compliance with these new regulations will become increasingly crucial.
This final rule’s first implementation phase must be examined closely by affected corporates and firms. It indicates the beginning of a likely continuing trend towards more environmentally friendly and sustainable practices in manufacturing and production.
