Court Upholds Judgment in Parnassus Heights Campus EIR Dispute, Denies Rehearing and Publication

Earlier this month, the First District Court of Appeal (Div. 3), brought the spotlight back onto a long-contested environmental impact report (EIR) for the Parnassus Heights Campus Long-Range Development Plan. It denied the petitions for rehearing and publication of their earlier order, while also modifying their opinion but leaving the judgment unchanged in the case titled Yerba Buena Neighborhood Consortium, LLC, et al. v. The Regents of the University of California.

The same was confirmed in an order released on October 20, 2023, which describes the modification in the Court’s opinion and the continued denial of publication and rehearing of the dispute. As reported by law firm Miller Starr Regalia, despite the changes, there was no effect on the judgment.

The litigation, focused on the EIR for the development plan at the Parnassus Heights Campus of the University of California, has drawn significant attention from environmentalists and legal professionals, who have been following this unfolding drama keenly since its initial stages. The order’s details and the implications it holds for all parties involved deserve a deeper look.
