Federal Reserve, FDIC, and OCC Issue Final Rule for Community Reinvestment Act Regulations

On October 24, 2023, three key financial oversight organs, the Board of Governors of the Federal Reserve System, the Federal Deposit Insurance Corporation, and the Office of the Comptroller of the Currency, issued a final rule amending their regulations implementing the Community Reinvestment Act (CRA). The announcement comes as part of the long-awaited update to the CRA regulations, as per this
news report.

These changes, known as the “Final Rule,” represent the first significant refresh to the CRA regulations in close to three decades, casting a new light on how banks’ CRA performances will be assessed and introducing important alterations to the regulatory landscape.

Major changes encapsulated within the Final Rule include a redesigned evaluation method that focuses on where each banking institution is accepting deposits, the types of customers it is serving, and where it is lending. This revision aims to steer the CRA toward its original mission of meeting local community needs, as illustrated by its emphasis on lending for activities such as charter schools, minority depository institutions, and low-income housing tax projects.

While the Final Rule will have broad implications for the banking industry, its impact will particularly be felt among large, intermediate, and small banking institutions. The extent of influence will depend on a bank’s size, overall operations, and engagement with the communities they serve.

With uncertainty cleared regarding the new regulations, banking institutions will need to adapt their strategies to effectively prepare for these changes. Embracing the shift in regulations while staying true to the goals of the CRA will be fundamental for banks striving to succeed in the new regulatory landscape.
