Supreme Court Adopts New Code of Conduct, Aligning with Lower Court Ethics Guidelines

In a recent development, the US Supreme Court announced a novel code of conduct, a substantial portion of which appears to draw from existing ethics guidelines that are already applicable to judges at lower courts. The announcement, however, reveals an impending departure of the Supreme Court’s rules from the ethics code for other judges.

The arrangements for outlining the conduct codes for the higher and lower echelon judges have traditionally been separate, a practice that has occasionally resulted in variances between the ethical guidelines for the two categories. The newly declared code for the Supreme Court is primarily a reiteration of guidelines that are already in place for judges in the lower courts, copying them almost verbatim.

This unusual move by the Supreme Court demonstrates its willingness to align its conduct codes with those mandated for their lower court counterparts, raising questions about whether future revisions will reflect a similar approach.
