Palestinian human rights organizations have initiated legal actions against President Joe Biden, Secretary of Defense Lloyd James Austin and Secretary of State Anthony Blinken, accusing them of breaching the duty to mitigate genocide and complicity in genocide related to the current Israel-Hamas conflict. The Center for Constitutional Rights (CRC) formally filed the case on behalf of Defense for Children International- Palestine, Al-Haq, and several individual plaintiffs impacted by the strife.
The plaintiffs allege that the US administration has been negligent in fulfilling its obligation to avert genocide. These groups accuse the Biden administration of aiding in setting up conditions for such actions by extending unequivocal military and diplomatic support to Israel. The plaintiffs are seeking a court order that would compel the Biden administration to take necessary measures to prevent Israel’s commission of alleged genocidal acts against the Palestinian people.
According to the complaint, the United States has failed to utilize its influence over Israel to alter the present predicament in the Gaza Strip. This negligence remains despite Israel’s persistent violations of international law, cites the complaint. In addition, the plaintiffs raised concerns about the continuous support extended to Israel from the Biden administration in light of the numerous calls for a ceasefire and significant civilian casualties.
The complaint makes a strong case that the Israeli government’s actions represent an unfolding genocide, citing a continued siege blocking infrastructure, widescale bombing, use of chemical weapons, and forced evacuation orders.
The complaint was filed with a declaration from leading legal experts on genocide as well as a declaration from Holocaust scholars. Both declarations bear statements that Israel’s actions can be interpreted as signs of genocide, paralleling other genocides in recent history.
US’s Coordinator for Strategic Communications at the National Security Council John Kirby, discussing the situation in Israel, mentioned that the Biden administration is primarily focused on rescuing the hostages and preventing further escalation during the ongoing conflict. Kirby emphasized that the US does not condone striking a hospital from the air, and hospitals and patients must be protected. The administration neither supports a ceasefire but is in favor of the humanitarian pauses introduced by the Israeli military.
