Eighth Circuit Upholds University Policy on Pamphlet Distribution, Finds No First Amendment Violation

In a recent ruling, the U.S. Court of Appeals for the Eighth Circuit upheld a policy implemented by Northwest Missouri State University that mandates any person wishing to distribute non-university-related publications on campus to seek administrative approval prior to doing so. The court found that this policy did not infrarium on the First Amendment.

The question brought before the court revolved around the university’s advance notification policy. This policy requires that those who wish to distribute “non-University publications,” such as pamphlets, on campus must first notify an administrator. The central issue was whether the act of instituting such a policy infringes on First Amendment rights.

In their published ruling, the court sided with the university, determining that the enforcement of this policy does not constitute a violation of the First Amendment. This decision paves the way for further exploration and understanding of the intersection of First Amendment rights and academia’s ability to set its own rules and guidelines on campus.
