LexisNexis Parent Relx Wins Protest Against US Air Force ‘Brand-Name-or-Equal’ Solicitation

In a recent development, Relx Inc., also known as LexisNexis, won its protest against the US Air Force’s decision to award a task order to West Publishing Co. for an electronic search and data tool license. As has now been revealed, West Publishing’s bid did not meet the requirement for a ‘brand-name-or-equal’ solicitation which stipulated that bidders were required to provide a brand-name LexisNexis license or a comparable equivalent.

This means that there are elements of West Publishing’s product that don’t match the characteristics of an equivalent solicitation. The Government Accountability Office (GAO) has recommended that the Air Force cancel the task order, modify the solicitation, assess revised bids, and issue a new award.

The chronology of these events draws attention once again to the critical nature of compliance within the ambit of legal contracts. It also underscores the necessity of establishing a robust system for assessing bids, especially in a ‘brand-name-or-equal’ schema where potential ambiguity may exist.
