Third Circuit Panel Revives Acrison’s Case in Alleged Hacking Scheme

A recent ruling by a Third Circuit panel has breathed new life into Acrison Inc.’s civil case against a law firm and a consumer computer services company. This case relates to an alleged hacking scheme that took place in 2020. The panel determined that the lower court had made an error in its initial decision, which had deemed Acrison’s claims to be time-barred.

In the original district court decision, the case against the firm Brach Eichler LLP and Xcellence Inc. had been dismissed on the grounds of a lapsed statute of limitations, for both the federal and state-level claims. The Third Circuit’s decision, however, has reversed this dismissal and has sent the case back for further proceedings.

The opinion filed in the U.S. Court of Appeals was put forth by Chief Judge Michael Chagares. In his remarks, he expressed that the lower court had not effectively applied the legal standard necessary for the initial decision.

This decision marks an important juncture in this ongoing legal saga, setting the stage for the case to continue its course under a renewed set of circumstances. To follow the progress of this noteworthy case, legal professionals are advised to stay tuned to further updates.
