Arkansas DEQ and City of Bay Address Clean Water Act Alleged Violations in Consent Order

The Arkansas Department of Energy & Environment – Division of Environmental Quality (DEQ) and City of Bay, Arkansas (“Bay”) have entered into a Consent Administrative Order (CAO), dated October 16, which deals with alleged violations of a Clean Water Act National Pollutant Discharge Elimination System (NPDES) permit. The agreement came to light in an article available here.

The order detailed that Bay operates a municipal wastewater facility in Craighead County, Arkansas and has been allegedly found to be in violation of its NPDES permit, a regulatory cornerstone in The Clean Water Act’s efforts to achieve water quality objectives.

While the complete details of the allegations in the CAO were not fully disclosed, the NPDES permits are notoriously strict. Primarily, they are designed to decrease the amount of pollutants released into the waters of the U.S by a significant number of point sources. This includes municipal sources, such as the case with Bay’s municipal wastewater facility, and many types of industrial sources.

For legal professionals specializing in environmental law, it will be interesting to observe how this situation unfolds, as it could have implications on the regulatory landscape. Moreover, it will also be crucial to follow how the enforcement agencies are handling alleged violations and the extent to which they are willing to negotiate on consent orders.
