SCOTUS to Reevaluate Landmark Chevron Framework in Upcoming January 2024 Oral Arguments

The U.S. Supreme Court (SCOTUS) has scheduled oral arguments for January 17, 2024, in two cases that challenge the precedent set in the 1984 decision of Chevron, U.S.A., Inc. v. Nat. Res. Def. Council, Inc., according to a news update by Ballard Spahr LLP.

This landmark ruling gave birth to what is today referred to as the “Chevron framework”. This is a two-step procedure that courts usually use when examining a federal agency’s interpretation of a statute. The issue at hand in these upcoming cases is whether the Court should overrule this 1984 decision in the light of current circumstances.

The Chevron framework has been a cornerstone of U.S administrative law for nearly four decades, guiding how courts address cases where administrative bodies have interpreted a statute in a particular way. Its potential overruling could have significant implications for the operations of federal agencies and how their decisions are reviewed by courts.

Interested parties, alongside legal professionals across the globe with stakes in U.S administrative law, are expected to keenly watch these court proceedings as they could set a new precedent for future agency-court relationships and reestablish how statutes are judicially interpreted.
