Lawsuit Erupts Between Law Firms over Alleged Trademark Infringement in Taglines

The Arnold Law Firm has initiated a federal lawsuit against Jacoby & Meyers, alleging the misappropriation of a tagline trademarked by the Arnold Law Firm. Notably, the dispute centers around what the Arnold Law Firm argues are similarities between the two firms’ marketing taglines, which could potentially create confusion among their clientele – all of whom are seeking legal representation in personal injury cases.

Sacramento-based attorney Craig A. Simmermon, who is representing the Arnold Law Firm, filed the litigation in the Eastern District of California federal court towards the end of 2023. Specifically, it alleges that Clayeo Arnold, the founder and president of the Arnold Law Firm, has been unjustly affected by Jacoby & Meyers’ promotional activities.

Arnold claims to have held ownership of the federal service mark “JUSTICE4YOU” since as early as 2007. Furthermore, it is alleged that the firm has poured nearly $5.5 million into its marketing operations which prominently featured this mark since 2010.
